Your EU Responsible Person under the General Product Safety Regulation

How to check whether a company has an EU Responsible Person

Under the GPSR, a consumer product may only be placed on the EU market if an economic operator established in the EU is responsible for it. Its name and contact details have to be visible, so in most cases you can check without asking anyone.

Where to look

1

On the product or packaging

Article 16(3) requires the name and contact details of the responsible economic operator on the product, its packaging, the parcel or an accompanying document.

2

In the online offer

For a manufacturer outside the EU, every distance-sales offer must show the name, postal and electronic address of the Responsible Person (Article 19). On marketplaces it is usually in the product safety or manufacturer information section of the listing.

3

Ask in writing

If neither shows it, ask the seller or brand for the Responsible Person's name and address. A business that sells legally in the EU can answer straight away.

Who can be the Responsible Person

Article 16(1) GPSR refers to the economic operators listed in Article 4(1) of Regulation (EU) 2019/1020. The Responsible Person must be established in the EU and be one of these:

OperatorWhen
Manufacturer established in the EUThe manufacturer itself is in the EU - no separate Responsible Person is needed.
ImporterAn EU company that places the non-EU product on the market.
Authorised representativeAppointed by the manufacturer with a written mandate covering the GPSR tasks.
Fulfilment service providerOnly where none of the operators above is established in the EU.

Red flags

Why there is no public register

The GPSR does not create a database of Responsible Persons, unlike for example EUDAMED for medical devices. The checks happen on the label and in the listing: market surveillance authorities and marketplaces look for the details there. Safety Gate publishes alerts about dangerous products, not a list of representatives.

If you sell under your own brand from outside the EU and your listings lack these details, marketplaces can remove them. Check whether you need an EU Responsible Person.

Frequently asked questions

Is there a public database of GPSR Responsible Persons?

No. The GPSR does not set up a register. The Responsible Person's name and contact details must appear on the product or its packaging and in every online offer, and that is where authorities and buyers check.

Can a fulfilment centre be the Responsible Person?

Only a fulfilment service provider established in the EU, and only for products for which no manufacturer, importer or authorised representative is established in the EU.

Does a product made in the EU need a separate Responsible Person?

No. If the manufacturer is established in the EU, it is itself the responsible economic operator and its own details on the product are enough.
